Skateboarder sues over fall at Stauffer Park

LANCASTER — A skateboarder who allegedly suffered injuries after hitting a defective path at a park is suing.

Todd Martin and Heidi Martin filed a complaint Feb. 2 in the Court of Common Pleas of Lancaster County against Manheim Township and John Does 1-5 alleging premises liability and negligence.

Todd Martin was riding his skateboard on a walking path near Stauffer Park in Lancaster on May 19, 2021, according to the plaintiffs' complaint. They allege that his skateboard hit a "large defective depression-type hole, filled with loose stones" which caused him to fall and suffer a broken femur which required surgical repair. 

They claim the defendants' negligence for failing to allow their premises to exist in a dangerous condition, failing to repair the defects of the portion of the pavement and failing to warn of the dangerous condition. The plaintiffs also claim the defendants failed to ensure their premises could be traversed in a manner that would not cause danger. The plaintiffs allege in addition to his physical injuries, Martin also suffered mental anguish and incurred medical treatment costs. 

The Martins seek monetary relief of more than $50,000, trial by jury and all other just relief. They are represented by Brandon Swartz, Larissa Staszkiw of Swartz Culleton PC in Newtown.
