Man alleges father was embalmed, buried by funeral home without next of kin consent

MEDIA — A man alleges his deceased father was embalmed and buried without his consent and against his religious beliefs. 

Naim Davis filed a complaint Feb. 14 against Lewis Hunt-Irving, Jr., Lewis M. Hunt-Irving Funeral Home, Crozer Chester Medical Center and others alleging negligence. 

Davis is the only son of Ronald Wilson, who passed away on Nov. 29, 2020, according to the plaintiff's complaint. Davis claims his father did not have a will or specify anyone to take control of his remains. 

Davis further claims that shortly after his father's death, his body was picked up from Crozer Chester Medical Center and taken to Lewis M. Hunt-Irving Funeral Home without his permission or consent. He alleges that his father's body was then embalmed and buried at Haven Memorial Cemetery in Chester and that both he and his father are/were Muslim do not believe in embalming. 

Davis also alleges his father's embalming and burial were both performed without the consent of his only offspring, which constitutes negligence. He claims the defendants were also negligent for failing to determine Wilson's next of kin or verifying and were in violation of state laws. 

Davis seeks monetary relief of more than $50,000 and all other just relief. He is represented by James Famiglio of The Law Offices of James D. Famiglio PC in Media.
