SCRANTON — A woman claims Sunbeam's liability after the company's smoothie blender allegedly malfunctioned and caused her hand to fall into the blades.
Pamela Harper filed a complaint Feb. 22 in the U.S. District Court for the Middle District of Pennsylvania against Sunbeam Products Inc., alleging strict liability.
Harper, according to her complaint, was using an Oster Pro 1200 with Blend-N-Go Smoothie Cup accessory that was manufactured and marketed by Sunbeam. She claims she was following the manufacturer's instructions and holding one hand on top the device when the Smoothie Cup fractured and collapsed and caused her hand to fall into the blades of the blender.
Harper alleges as a result of the blender's malfunction, she suffered injuries to her hands, her middle, fifth and fourth fingers on her left hand. She also alleges she suffered scars, permanent limitations, emotional trauma and lost income and incurred medical expenses. Harper claims Sunbeam's strict liability for the "catastrophic failure" of the blender which had no cracks or visible damage at her time of use.
Harper seeks monetary relief, trial by jury and all other just relief. She is represented by Michael Zicolello of Schemery Zicolello in Williamsport.
