LANCASTER — A woman is claiming negligence against the person who allowed her to ride on top of a mower as a minor, which caused her foot to nearly be severed.
Caylin Kepler filed a complaint March 11 in the Court of Common Pleas of Lancaster County against Elaine Koob also known as Elaine Parmer, Elaine Royer and Elaine McIntyre alleging negligence.
Kepler alleges that on Sept. 9, 2006, when she was 4 years old, she was playing with other children at a property on Germantown Avenue in Christina. She claims the defendant placed the children on a mower and drove it around the property and that she fell off the mower, with her left foot becoming lodged under the mower.
Kepler further claims the defendant put the mower in reverse and nearly severed her foot, which caused her to lose a large amount of blood and go into shock. She alleges the defendant's negligence for placing minor children in danger and violated state law by endangering the welfare of the children.
Kepler also alleges the defendant failed to properly supervise the minor children, have the mower under proper control and failed to stop the mower when she knew or should have known that injury was imminent. Kepler claims she has suffered permanent damages to her foot including from burns and injuries to muscles, tendons and nerves.
Kepler seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. She is represented by Attorney Lauren Levin Geary in Philadelphia.
