Amtrak worker alleges he faced bullying, intimidation to not report on the job injury

PHILADELPHIA — An Amtrak worker claims he faced intimidation and bullying from a supervisor after suffering an on-the-job injury. 

Matthew Daley filed a complaint March 23 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corporation (Amtrak).

Daley, an employee of Amtrak, was working at the Frazer storage track in Malvern on July 14, 2020, according to his suit. He alleges that while parking his ballast regulator, a machine crashed into him and caused him to suffer injury to his lower back. 

Daley claims that when his supervisor arrived at the work site, he verbally assaulted him including stating "you know you are a piece of shit right?" He further claims that out of fear for his job, he did not want to report the injury.

However, it was reported to Amtrak Police and when he was forced to make a statement about the accident, the supervisor texted him a statement of what he wanted him to report. Daley claims he feared retaliation outside of work from the supervisor and that in addition to his physical injuries, he also suffered emotional issues. 

Daley seeks monetary relief, trial by jury and all other just relief. He is represented by James Duckworth of Keller & Goggin PC in Philadelphia.
