Wages class action seeks pay for shower time

PITTSBURGH — A Pittsburgh manufacturing company is facing a claim it violated state and federal wage laws by not paying its workers to complete their pre-shift duties. 

Ryan Ruffa, individually and on behalf of all class members filed a complaint March 24 in the Court of Common Pleas of Allegheny County against Ferro Corporation alleging violation of the Pennsylvania Minimum Wage Act. 

According to the class action complaint, Ruffa was employed by Ferro from March 2015 through September 2021 as a manufacturing/production employee at the company's Washington County facility. He claims that he and other manufacturing/production employees were only paid for work from their scheduled start and end times which did not include changing into personal protective equipment, obtaining their work instructions and assignments and walking to and from the production floor. 

Ruffa also claims employees were not paid for performing their production and manufacturing work or for time they had to shower after their shifts. He alleges Ferro violated state and federal wage laws by requiring employees to arrive at work early and perform their required pre-shift work and not being paid overtime.  

Ruffa and the class seek monetary relief, interest, trial by jury and all other just relief. They are represented by Joshua Geist and William Goodrich of Goodrich & Geist PC in Pittsburgh.
