Former hospice facility executive director claims age discrimination

PHILADELPHIA — A former executive director of Seasons Hospice & Palliative Care claims he faced age discrimination. 

Arthur Alan Henderson, Jr., filed a complaint April 5 in the U.S. District Court for the Eastern District of Pennsylvania against Seasons Hospice & Palliative Care of Pennsylvania LLC, Diane Wojciechowski and Theresa Bergeron alleging violation of the Age Discrimination in Employment Act (ADEA). 

Henderson, who is 69 years old, began working for Seasons when he was 68 and in March of 2020, was hired as executive director. He alleges that prior to his onboarding and orientation, the defendants had never met him in person. 

Henderson claims on Aug. 3, 2020, he was fired for alleged poor work performance without being given any examples and was replaced by a substantially younger person. He further claims Seasons terminated three employees between 2017 and 2020 whose ages were 54, 58 and 65. Henderson alleges he was terminated due to age discrimination and that he was subjected to a hostile work environment including abuse, ridicule, insults, criticism and contempt on a weekly basis. 

He also alleges as a result of the discrimination, retaliation and termination, he suffered lost wages and benefits. 

Henderson seeks monetary relief, trial by jury and all other just relief. He is represented by Erica Shikunov of The Derek Smith Law Group PLLC in Philadelphia.
