PITTSBURGH — A couple are claiming negligence against a camping resort after the wife allegedly tripped over a raised weather strip on an entryway and suffered serious injuries.
Brenda Boetger and Timothy Boetger filed a complaint April 7 in the U.S. District Court for the Western District of Pennsylvania against Wagon Trails Resort Inc., and Wagon Trails Resort Inc., doing business as Millbrook Resort alleging negligence.
The Boetgers were at the Millbrook Resort on State Route 46 South in New Lyme, Ohio, on Sept. 19, 2020, according to the plaintiffs' complaint. They claim that they had a rental arrangement for the campsite with a friend who was a Millbrook Resort member.
The plaintiffs allege that as Brenda Boetger was entering the resort's indoor game room, she encountered an "unmarked and hidden step down" with a raised weather strip which caused her to fall. They further claim as a result of her fall, Brenda Boetger suffered a fractured tibia which required surgery as well as other injuries.
The plaintiffs allege Millbrook's negligence for creating the dangerous condition and allowing the hazard to exist in the entryway. They also allege Millbrook failed to maintain and inspect its property or warn of the hazardous condition.
The Boetgers seek monetary and all other just relief. They are represented by Bryan Neiderhiser and Bradely Holuta of Marcus & Mack PC in Indiana.
