MEDIA — A woman who tripped over an allegedly defective curb while trying to escape an attack from a loose dog is alleging the City of Chester's and the dog's owners' negligence.
Kiana Jones filed a complaint April 6 in the Court of Common Pleas of Delaware County against Community Action Agency of Delaware Inc., John Does 1-5, City of Chester, Jamirah Jackson and Darren Jackson alleging negligence.
According to her suit, Jones was walking on the sidewalk on Yarnall Street in Chester on April 11, 2020. She alleges that she saw a small, unleashed dog that was barking and growling run towards her and then tried to grab ahold of her boot. She further alleges that as she tried to get way from the dog, she tripped and fell on a defective condition that was on the curb.
Jones claims Jamirah Jackson owned the unleashed dog which was under the care of her father Darren Jackson and that the defendants failed to properly restrain the dog. Jones claims the City of Chester's negligence for failing to inspect or correct the dangerous condition on the curb.
Jones seeks monetary relief, of more than $50,000, interest, trial by jury and all other just relief. She is represented by Robert Lynch and Rob Feeney of Hoffman, Sternberg, Karpf & Lynch LLC in Southhampton.
