MEDIA — A residential living facility for developmentally challenged individuals is facing claims it allowed one of its residents to be sexually assaulted by another resident.
April Olinchak, guardian of the Estate of Thomas Krug, an incapacitated person filed a complaint April 12 in the Court of Common Pleas of Delaware County against Carelink Community Support, John Doe and others alleging negligence.
According to the plaintiffs' complaint, Krug was placed at a residential facility located on Hollis Avenue in Lynn owned by the defendants. The plaintiffs allege Krug was physically and sexually assaulted by another adult male, T.P., at the facility and that T.P., had a history of violence.
They further allege that despite the defendants knowing about T.P.'s history of sexual violence, they placed him in an apartment with Krug. They also claim the defendants failed to provide adequate evaluations, living arrangements and supervision and that they knew or should have known that Krug was repeatedly sexually and physically assaulted by T.P. The plaintiffs allege the defendants' negligence for failing to hire and train staff to identify and correct the situation which caused Krug to suffer permanent physical and emotional injuries.
The plaintiffs seek more than $50,000, trial by jury and all other just relief. They are represented by Justin Berstein of Kenneth R. Schuster & Associates PC in Media.
