IP Litigator Caryn Borg-Breen, Ph.D., Joins Ballard Spahr

Caryn Borg-Breen—an accomplished patent litigator with more than 20 years of experience handling intellectual property matters—has joined Ballard Spahr as a partner, firm Chair Mark Stewart announced today. She will be based in Chicago and will travel to other Ballard Spahr offices as the needs of her clients dictate.

In addition to representing both plaintiffs and defendants in patent litigation, Dr. Borg-Breen counsels clients on various IP issues and handles patent prosecution. A significant percentage of her practice during the past 15 years has been in Hatch-Waxman litigation representing brand pharmaceutical companies against generic ANDA filers in matters pending in the District of Delaware and District of New Jersey.

“Caryn’s broad skill in Hatch-Waxman patent litigation and pharmaceutical patent counseling, particularly on issues involving small molecules, makes her an excellent fit for our national IP team,” said Lynn E. Rzonca, Chair of the firm’s Intellectual Property Department. “Caryn joins our deep bench of life sciences attorneys, helps us expand in the Midwest, and broadens our lifecycle capabilities. Our clients are going to appreciate Caryn’s expertise, and I’m excited to welcome her.”

Dr. Borg-Breen has served as lead trial counsel in multiple patent trials in United States district courts, and has argued numerous appeals before the Federal Circuit. She also has significant experience drafting and negotiating patent licensing agreements.

Ballard Spahr’s Intellectual Property Department comprises more than 50 attorneys and professionals, including more than 20 registered patent practitioners with technical knowledge in fields from chemistry to bioinformatics. The IP Department has received multiple top accolades in the most recent edition of Best Law Firms, including National Tier One Rankings for Copyright Law, Intellectual Property Litigation, Patent Litigation, Patent Law, and Trademark Law.

Prior to joining Ballard Spahr, Dr. Borg-Breen was a founding partner of Green, Griffith, & Borg-Breen LLP, a boutique firm in Chicago, where she advised biotechnology, chemical, and pharmaceutical companies on freedom-to-operate, due diligence, licensing, and prosecution issues regarding brand and generic medicines, biologics and biosimilars, medical devices, and chemical products.

“Ballard Spahr has a deep bench of talent and has built one of the top intellectual property practices in the country,” Dr. Borg-Breen said. “I’m thrilled to be joining this accomplished team and working with them to find solutions for our clients.”
