Truck driver alleges Walmart employee struck him with pallet jack while unloading freight

PITTSBURGH — A truck driver alleges a Walmart employee struck him with a pallet jack while his freight was being unloaded at a Walmart Supercenter in Allegheny County. 

James D. Brady filed a complaint April 21 in the Court of Common Pleas of Allegheny County against Walmart Inc., Walmart Supercenter and Jane Doe alleging negligence. 

According to his complaint, Brady was working as a truck driver for Marten Transport and travelled to the Walmart Supercenter in North Versailles in Allegheny County on April 26, 2020. He alleges that he backed the truck into the bay to be unloaded and that the truck was being unloaded by Walmart employee Jane Doe. 

Brady claims Doe struck him with a pallet jack and caused him to be pinned between the pallet and a stack of empty pallets in the unloading area. He further claims as a result of the accident, he suffered lost wages, pain and incurred medical bills. Brady claims Walmart is liable for Doe's actions and the damages she caused him to suffer. 

Brady seeks monetary relief of more than $35,000, trial by jury and all other just relief. He is represented by Russell Gerney of The Law Offices of Russell Gerney in Wheeling, W.Va.
