Worker alleges defective scaffolding caused his more than nine-foot fall

PHILADEPHIA — A worker alleges defective scaffolding caused him to fall more than nine feet and suffer multiple injuries. 

Tyrone Cook and Sheila Harris-Cook filed a complaint April 20 in the U.S. District Court for the Eastern District of Pennsylvania against Omega II Inc., doing business as Metaltech and others alleging negligence. 

Cook, according to his complaint, was working at the La Colombe coffee processing plant in Philadelphia on June 9, 2020. He alleges he was working on a scaffold that was designed and manufactured by the defendants when he fell about nine to 15 feet from the scaffold which had no safety devices and had a broken weld on the kick plate. 

Cook alleges as a result of the fall, he suffered injuries to his shoulder that required surgery and bulging discs in his neck and back as well as other injuries. He claims the defendants' negligence for failing to adequately inspect the scaffold for hazardous conditions, for failing to properly train and supervise its employees and failing to warn of the dangerous and unsafe conditions. 

He also claims the defendants violated OSHA standards by not having proper fall protection on the scaffold. Cook alleges the defendants were negligent for not enforcing the use of safety devices and failed to provide complete instructions on the use, assembly, repair and maintenance of the scaffolding.  

Cook seeks monetary relief of more than $75.000,
