Woman alleges she found maggots in her drink at Wendy's

PITTSBURGH — A woman alleges she found maggots in her drink at a Wendy's restaurant in Plum.

Angela Blasko filed a complaint March 15 in the Court of Common Pleas of Allegheny County against Primary Aim LLC, doing business as Wendy's Restaurant, alleging negligence and breach of warranty.

Blasko claims in her suit that she purchased food from Wendy's in Plum on April 6, 2021. She alleges that as she removed the drink lid to refill her cup, she noticed "foreign objects" in the cup which were maggots and that she became nauseous and ill. 

Blasko further alleges that she went to the same Wendy's on Aug. 2, 2021 and became sick due to rotten lettuce that was on her chicken sandwich. She claims the Allegheny County Health Department inspected the Wendy's restaurant and found flies and maggots in the area where the cups were being stored. 

Blasko alleges the defendant's negligence for failing to properly store and inspect its cups and lettuce before serving to customers and for storing products in violation of health codes. She also alleges the defendant failed to properly train and supervise its employees on how to properly prepare and serve products in a safe manner. 

Blasko seeks monetary relief of more than $50,000 and all other just relief. She is represented by Bernard Caputo of The Caputo Law Firm LLC in Pittsburgh.
