PITTSBURGH — A nightclub patron who was allegedly assaulted by an intoxicated patron is alleging negligence against his attacker and the bar's owners.
Tyler Stetson filed a complaint against Rich Whiting, John J. Catanese and Deborah H. Cantanese, individuals and doing business as Cosmo on Carson and MD Real Estate LLC alleging negligence.
According to his complaint, Stetson was at the defendant's Cosmo on Carson nightclub on June 14, 2020. He claims he was assaulted by Whiting who had previously committed other violent acts at the nightclub.
Stetson alleges he suffered facial trauma, lacerations and head trauma and incurred medical bills for hospitalization, medical and surgical supplies as well as lost wages. Stetson claims Whiting's negligence for attacking him after becoming intoxicated.
He alleges Cosmo on Carson's negligence for failing supervise, control and guard its bar and nightclub and failing to have adequate security personnel to prevent violent and dangerous acts. Stetson also alleges Cosmo on Carson negligently and illegally served Whiting alcohol while he was visibly intoxicated. He claims Cosmo on Carson failed to monitor the activities at the nightclub, implement and enforce safety procedures and did not train their workers to identify and remove patrons who posed a danger.
Stetson seeks $50,000, trial by jury and all other just relief. He is represented by Edward Balzarini, Jr., of Balzarini & Watson in Pittsburgh.
