Suit: Military academy students with medical issues forced to engage in unsafe activities

MEDIA — A military academy in Wayne is facing a claim it forced students with medical issues to engage in activities which caused them to suffer injuries. 

Lake Lee, a minor by and through Matthew Lee, and Matthew Lee in his own right filed a complaint May 6 in the Court of Common Pleas for Delaware County against Valley Forge Military Academy and Valley Forge Military Academy Foundation alleging negligence. 

According to the plaintiffs' complaint, Lee was a student at Valley Forge Academy. The plaintiffs claim that on Sept. 7, 2020, Lee suffered serious injuries after falling from his bed including a femur fracture which required surgical repair. 

The plaintiffs further claim that Valley Forge Academy's agents and employees ignored Lake Lee's medical doctor's written instruction and forced him to participate in activities which caused his legs to be in a weakened state. 

They allege Valley Forge's negligence for failing to maintain a safe environment for Lee and for allowing the staff to improperly engage medically unstable students in inappropriate activities. They also allege Valley Forge failed to follow state and local healthcare polices or properly monitor its employees and failed to obtain proper medical treatment for the minor Lake Lee. 

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by Benjamin Hoffman of Clearfield & Kofsky in Philadelphia.
