Pittsburgh Pirates employee who fell in pothole outside of PNC Park claims negligence

PITTSBURGH — A Pittsburgh Pirates ticket representative claims he fell into a pothole after leaving work outside of PNC Park. 

Michael E. Flanagan and Theresa Flanagan filed a complaint March 10 in the Court of Common Pleas of Allegheny County against Pittsburgh Pirates Inc., alleging negligence. 

According to the plaintiffs' complaint, Michael Flanagan was working as a ticket sales representative for the Pittsburgh Pirates on April 23, 2021. He alleges that as he left work, he fell into a pothole on the sidewalk outside of PNC Park near General Robinson and Federal streets.

They allege that Flanagan's Workers' Compensation claim was denied based on the time of his injury and that as a result of his fall, he suffered a fractured elbow that required surgical repair and incurred medical treatment costs. The plaintiffs claim the defendant's negligence for failing to properly inspect and maintain the sidewalks, failing to properly repair the sidewalks or warn of the dangerous condition. 

They further claim the defendant violated state statues and local ordinances related to the maintenance of a business premises. The plaintiffs also claim the defendants knew or should have known of the dangerous condition of the sidewalks. 

The plaintiffs seek monetary relief, trial by jury and all other just relief. They are represented by Jason Luckasevic of Goldberg, Persky & White in Pittsburgh.
