PITTSBURGH — A woman alleges a medical transport company's negligence led to her fall and multiple leg fractures.
Cheryl Vogtsberger filed a complaint in the Court of Common Pleas of Allegheny County against Access2Care LLC, American Medical Response LLC, American Medical Response Mid-Atlantic, Inc., and Global Medical Response, Inc., alleging negligence.
According to her complaint, Vogtsberger was furnished transportation by the defendants on June 5, 2020. She alleges that she requested a low riding vehicle due to lacking the physical strength to board a higher vehicle but was furnished a van with a high step up.
She further alleges that the defendants' driver encouraged her to attempt to enter the van without providing her any assistance. Vogtsberger claims while entering the van, she lost her grip while holding onto the railing and fell onto her right leg.
She alleges as a result of the fall, she suffered multiple fractures to her leg which required surgery as well as abrasions, strains and sprains on her hands, body, wrist, leg, knee and elbow. Vogtsberger claims the defendants' negligence for failing to provide her with a safe mode of transportation, failing to assist her and failing to warn her of the hazardous condition. She also claims the defendants ignored her repeated requests for safe transport.
Vogtsberger seeks monetary relief, interest and all other just relief. She is represented by G. Christopher Apessos of Apessos Law LLC in Pittsburgh.
