PITTSBURGH — A couple allege an overloaded concrete truck and negligent truck driver caused a collision and the husband's severe injuries.
William McWreath and Rosella R. McWreath filed a complaint May 9 in the Court of Common Pleas of Allegheny County against JC Howard Concrete LLC an Andy R. Harkleroad alleging negligence.
William McWreath, according to the plaintffs' complaint, was driving his Ford Escape and pulling out of his driveway on Sept. 4, 2020. They claim that as McWreath turned onto the road outside his driveway, he was struck by the defendant's concrete truck that was being operated by Harkleroad. The McWreaths allege that Harkleroad was carrying an excessive weight load on the truck and was speeding.
Specifically, the McWreaths claim that JC Howard Concrete's truck was loaded with eight yards of concrete with a weight load of more than 32,000 pounds. According to their complaint, the truck weighed approximately 27,000 pounds, which made the total weight around 60,000 pounds or 30 tons, which is over the permissible weight limit for Ewing Road. They allege William McWreath suffered a spinal fracture, rib fractures and other injuries as a result of the collision. The plaintiffs also claim the defendants' negligence for using a residential road as a short cut while knowingly having an excessive weight.
The McWreaths seeks monetary relief, trial by jury and all other just relief. They are represented by Robert Daley of Robert Peirce & Associates PC in Pittsburgh.
