Suit: Customer trips over motorized cart electrical cord at Shoprite store

MEDIA — A customer at a ShopRite store in Eddystone claims he tripped over an electrical cord from a motorized shopping cart.

Michael Fiore filed a complaint July 5 in the Court of Common Pleas of Delaware County against Collins Markets LLC and ShopRite of Eddystone alleging premises liability and other claims. 

Fiore, according to his complaint was at the ShopRite of Eddystone on Jan. 30, 2021. He claims that while at the store, he tripped and stumbled over an electrical plug-in cord of a motorized shopping cart and suffered serious personal injuries. 

Fiore alleges ShopRite's negligence for failing to inspect its motorized shopping carts for any dangerous or defective conditions. He also alleges ShopRite failed to remove the dangerous condition and secure the electric cord of the motorized shopping cart and that it failed to comply with building codes or county and city laws and ordinances. 

He claims ShopRite also failed to barricade or block off the hazardous area. Fiore claims he suffered impairment, disfigurement, aggravation of pre-existing conditions including a fractured toe and a left knee sprain and also incurred medical treatment costs. 

Fiore seeks monetary relief of less than $50,000 and all other just relief. He is represented by Brian McGovern of Kwartler Manus LLC in Philadelphia.
