PHILADELPHIA — A Jenkinstown man is claiming he received robocalls from the Dr. OZ for Senate campaign despite being on the National Do Not Call Registry.
Andrew R. Perrong filed a pro se complaint July 11 in the U.S. District Court for the Eastern District of Pennsylvania against Dr. Oz for Senate and Mehmet Oz alleging violation of the Telephone Consumer Protection Act.
Perrong claims in his suit that his phone number has been on the National Do Not Call Registry continuously since 2005. He alleges that despite being on the National Do Not Call Registry, he received robocalls from the defendant on March 5, April 20 and May 16, 2022.
Perrong alleges he is charged for each call he receives and that his VoIP telephone service charges a "ring charge" for the caller ID name even if the call is not answered. He further alleges he is charged per minute for voice charges placed to his number.
Perrong claims he never gave consent or requested the calls and that the calls were not an emergency and that he was deprived of legitimate use of his phone and privacy. He alleges the defendants' placing the calls constitute a violation of the Telephone Consumer Protection Act.
Perrong seeks monetary relief, trial by jury and all other just relief.
