Suit: Patron struck in head by loose outside umbrella on restaurant deck

PITTSBURGH — A restaurant patron allegedly struck in the head when an umbrella on an outside deck table became dislodged is claiming negligence. 

Deborah Jackson and William Jackson filed a complaint June 19 in the Court of Common Pleas of Allegheny County against RSG Inc., doing business as Roland's Seafood Grill alleging negligence. 

Deborah Jackson and her daughter were at Roland's Seafood Grill in Pittsburgh on Sept. 27, 2020, according to the plaintiffs' complaint. The plaintiffs claim Jackson was on the second-floor deck area of the restaurant when an umbrella from a neighboring table dislodged, went airborne and hit her in the head. 

They allege that Jackson suffered a traumatic brain injury, concussion, memory loss, speech deficits, balance problems and injury to her neck and back as well as other parts of her body. The plaintiffs claim Roland's Seafood Grill's negligence for allowing an improperly fastened outdoor umbrella to exist on the outside deck area of the restaurant and for setting up the umbrellas in an improper manner. 

They also claim the umbrella was improperly assembled and that the restaurant failed to inspect the umbrellas and premises or to give sufficient warning about the hazard. The plaintiffs allege Roland's was negligent for failing to prevent or remove the dangerous condition or monitor the weather conditions to determine if the outside deck area was safe. 

The plaintiffs seek monetary relief, interest, trial by jury and all other just relief. They are represented by Shawn Kressley and Christopher Miller of Delvecchio & Miller LLC in Pittsburgh.
