Man claims he suffered serious illness after eating contaminated Daily Harvest food

MEDIA — A couple allege the husband suffered serious illness after eating a contaminated food product ordered from Daily Harvest. 

Daniel Davis and Lindsey Davis filed a complaint July 18 in the Court of Common Pleas of Delaware County against Daily Harvest Inc., alleging negligence and other claims. 

The Davises allege in their suit that they ordered the defendant's French "Lentil + Leek Crumbles" through their online subscription in June of 2022. They claim that on June 14, 2022, they thawed and cooked the product and after consumption, Daniel Davis began to have abdominal pain, fevers and chills. 

The plaintiffs allege that Davis' illness continued and a few days after consuming the defendant's product, he was admitted to the hospital and diagnosed with acute liver toxicity. They claim Daily Harvest was negligent for failing to use reasonable care in the manufacturing, packaging and distribution of its food product which became contaminated with bacteria. 

The plaintiffs further claim that Daily Harvest's food was not fit for human consumption and constitutes a breach of implied warranty. The plaintiffs allege Daily Harvest failed to comply with federal, state and local laws and safety codes with the distribution and sale of its food product.

The plaintiffs seek monetary relief, trial by jury and all other just relief. He is represented by Edward Levicoff and Lawrenz Fares of The Levicoff Law Firm PC in Pittsburgh.
