PHILADELPHIA — A couple claim a defective chair at a resort in Mexico caused the husband to hit the ground and suffer fractures to his arm and back.
William Ingram and Nikia-Scott Ingram filed a complaint July 19 in the U.S. District Court for the Eastern District of Pennsylvania against Majestic Elegance Costa Mujeres, Pamilla, NV, Cardena Mar SL, Majestic Resorts and others alleging negligence and other claims.
According to their complaint, the Ingrams purchased a vacation package from Empress Travel, a travel agency working on behalf of the Majestic Elegance Costa Mujeres resort. They allege that while at the Majestic Elegance on July 19, 2021, William Ingram sat on a wicker chair at one of the restaurants, and it suddenly broke and caused him to fall and hit the ground.
The Ingrams claim he suffered fractures to his arm and back as a result of the fall. They allege the defendants' negligence for failing to inspect and discover the defective condition of the chair, failed to warn of the dangerous condition and allowed the hazard to exist on their property. They also allege the defendants were negligent for failing to have chairs that could withstand the weight of all invitees, failing to make sure the chairs had materials and accessories that were safe and for not using appropriate chairs for the floor type at the restaurant.
The Ingrams seek monetary relief, trial by jury and all other just relief. They are represented by Jason Javie of Friedman & Levin Associates in Philadelphia.
