Tenant who fell 12 feet through attic floor claims landlord's negligence

Lawsuits

PITTSBURGH — A tenant is claiming her landlord's negligence after she fell 12 feet through the flooring in the attic and suffered serious injuries.

McKenna S. Cousins filed a complaint  June 25 in the Court of Common Pleas of Allegheny County against Venusian Management Group LP and BM Management Group LLC alleging negligence.

Cousins, according to her complaint, rented a property from the defendants located on Cedarhurst Street in Pittsburgh. She alleges that on Dec. 17, 2020, she was in the attic at the property to get Christmas wrapping when the attic floor suddenly gave way and caused her to "violently" crash through the floor.

Cousins further alleges she fell 12 feet below into the bedroom and suffered fractures, tissue swelling and surgical scaring, as well as emotional issues. She claims the defendants' negligence for allowing the dangerous, hazardous and unsafe floor to exist and for failing to maintain the premises.

Cousins also claims the defendants were negligent for failing to maintain and inspect the premises and for failing to warn of the hazardous and defective condition on the rental property. She alleges as a result of her fall through the floor, she also suffered pain, inconvenience and incurred large sums of money for medical expenses.

Cousins seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Ian Watt of Friday & Cox LLC in Pittsburgh.
