MEDIA — The owner and property manager of a residence in Chester are facing a negligence claim after the bedroom ceiling collapsed on top of a woman.
Nakia Coleman filed a complaint Sept. 7 in the Court of Common Pleas of Delaware County against Herbert Coe and Pure Prosperity Unlimited, alleging negligence.
According to her complaint, Coleman was at the defendants' property on Central Avenue in Chester on July 27, 2021. She alleges that while in the bedroom, a portion of the ceiling collapsed, fell onto her "body and limbs" and caused her to suffer a fractured arm and other injuries.
Coleman claims the defendants' negligence for failing to maintain their premises and allowing the premises to be in a deteriorated, defective and hazardous condition. She also claims the defendants were negligent for not warning her of the dangerous condition and for not properly performing their "common law and ordinance duties" as well as for allowing the hazard to exist. Coleman alleges in addition to pain and suffering, she also incurred large sums of money for medicine and medical attention. She also alleges the defendants did not properly inspect the premises or exercise due care.
Coleman seeks monetary relief of more than $50,000 and all other just relief. She is represented by Daniel Linn and Joseph Comerford of Aversa & Linn PC in Philadelphia.
