Under the new rules, an employer that is presented with a demand for recognition by a labor organization that can demonstrate majority support must promptly file an election petition with the NLRB or face liability for failing to recognize and bargain with the union. In the past, it has been up to the union to petition the board. Even worse, an employer requesting an election that is later found to have committed even a single unfair labor practice prior to the election may be faced with a bargaining order, notwithstanding the results of the election.
