Tek Shibakoti on May 25: 'Sborder; Following The Preliminary Settlement Negotiations Between The Parties, And With The Full Consent Of The Parties, Pursuant To Rule 65(b)(2), The Following Order Is Entered: And Now, This 25th Day Of May 2023; It Is Hereby Ordered That The Temporary Restraining Order, Entered On May 19, 2023, Shall Remain In Full Force And Effect Until A Final Settlement Agreement Is Executed By The Parties, With The Following Qualification: Defendants Siwakoti, Shibakoti, And Timsina (and Anyone Acting On Their Behalf) Shall Not Initiate Contact By Any Means With Any Intra-national Client Or Care Giver. It Is Understood That Clients And/or Caregivers Who Are In Possession Of Either Shibakotis Or Siwakotis Cell Phone Numbers May Contact Them Regarding Their New Employment With Star Plus. If Such Contact Occurs, Siwakoti And/or Shibakoti Shall Be Permitted To Inform The Client And/or Caregiver Of Their Employment With Star Plus, But Shall Refrain From Making Any Statements About Star Plus Or Intra-national In An Effort To Entice The Client And/or Caregiver To Sign Up With Star Plus, But Instead Shall Direct The Client And/or Caregiver To Contact The Main Office Number For Star Plus If They So Choose. It Is Further Ordered That The Parties Shall File A Joint Status Report On Or Before June 25, 2023. If The Parties Have Not Reached A Settlement By June 25, 2023, The Court Will Set A Time For A Status Conference To Discuss Further Extension Of The Temporary Restraining Order.
