YORK - Parents are suing Wellspan York Hospital for not getting the remains of a fetus to their preferred funeral home in a timely fashion.
Wellspan Health, a prominent healthcare provider, is facing a lawsuit filed by Chantel Horner and Ryan Madara. The plaintiffs are represented by attorney Thomas P. Lang of Law Offices of Dale E. Anstine, and the case was filed in the Court of Common Pleas of York County on Jan. 22.
The suit indicates Horner suffered a miscarriage in 2023 and went to Wellspan York Hospital for a dilation and curettage procedure to remove the fetus' remains.
Both parents say they told staff that the remains should be sent to Gladfelter Funeral Home, and Horner was discharged Nov. 25.
But three days later, Horner called the funeral home "and was informed that (it) had no knowledge of her baby's remains being transported there."
A phone call to Wellspan provided no answers until the remains were delivered on Nov. 30, the suit says. The plaintiffs claim this uncertainty and delay caused them great mental and physical pain and suffering, among other issues.
