Pittsburgh lawyer says firm retaliated for missed COVID time

PITTSBURGH - Bouts with COVID and Lyme disease created friction with his employer, a Pittsburgh lawyer alleges in a discrimination lawsuit against Frost Brown Todd.

A lawsuit has been filed against the law firm Frost Brown Todd, LLP by Ericson P. Kimbel, a former non-equity partner at the firm. The case was filed in U.S. District Court for the Western District of Pennsylvania on Feb. 1.

Kimbel alleges that despite generating millions of dollars in attorney’s fees and originating significant work for FBT, the firm continuously refused to provide necessary associate and staff support for his practice. 

He also claims that he was forced to work an excessive number of administrative hours due to this lack of support.

The plaintiff further alleges that he suffered from various disabilities including Lyme disease, anxiety, sleep apnea and bouts of COVID-19 with significant long-lasting effects during his time at FBT. 

Despite these health issues, Kimbel states that he managed to collect over $1.7 million in revenue for FBT in 2020 and over $2.2 million in 2021.

But a lack of hours kept him from scoring a promotion, and his pay was later cut. After more disputes, and the onset of insomnia, Kimbel was fired in June 2023. He says the firm retaliated against him for the medical issues from which he was suffering.

Kimbel is represented by Robert A. Bracken and Bracken Law Firm, LLC. The lawsuit is brought under the Americans with Disabilities Act.
