PHILADELPHIA - A Pennsylvania man is suing the online firearms retailer Primary Arms, claiming it is sending personal information relating to purchases to a third party.
Primary Arms LLC is facing a class action lawsuit filed Feb. 20 by plaintiff Kenneth McQueen in Philadelphia federal court The suit alleges that Primary Arms, in collaboration with third parties including Listrak Inc., intercepted communications containing protected information about firearms purchases made by Pennsylvania residents through the company's website.
McQueen purchased a firearm from Primary Arms' website in May 2023. Primary Arms, LLC is a Texas-based limited liability company that sells firearms and firearm accessories through its website.
The complaint further alleges that Primary Arms assisted Listrak in intercepting McQueen's communications without his knowledge or consent, breaching confidentiality and unlawfully disclosing personally identifiable information.
