MEDIA - A 5-year-old's fall from playground equipment at a Delaware County school is the subject of a recent lawsuit.
A lawsuit has been filed against the Episcopal Community Services of the Diocese of Pennsylvania, William Penn School District, Park Lane Elementary School, and several unidentified defendants by Madison Wingfield, a minor represented by her parent and natural guardian Litiesha Johnson.
The case was filed March 7 in the Delaware County Court of Common Pleas. The plaintiffs are represented by Arthur R. Sagoskin from Curtin & Heefner LLP.
The complaint alleges that the defendants failed to properly supervise school children during "after hours" programs which included playground activities. The plaintiffs argue that this lack of supervision led to an unspecified incident or harm.
Madison fell from a ladder onto ground that was not "properly maintained or prepared according to recognized and acceptable standards in order to absorb a fall" on April 21, 2022, the lawsuit says.
Madison broke her elbow, among other injuries.
