PITTSBURGH - An Indiana County man says he bought a defective ladder at Lowe's that broke while he was washing his car.

Lowe's Companies, Inc. is facing a lawsuit recently filed by James Eddy and Janice Eddy in the Court of Common Pleas of Indiana County, and Lowe's recently removed the case to Pittsburgh federal court.

James says he bough a Kobalt 3-step aluminum ladder on May 10, 2022, at Lowe's. Nine days later, he was washing his vehicle while using the ladder.

"Suddenly and without warning, the leg of the ladder collapsed causing the plaintiff to fall and sustain severe injuries," the suit says.

"Defendant knew or should have known that the ladder could fail and that the ladder therefore posed a substantial risk of serious bodily injury to users such as the plaintiff."

The suit says James was actually life flighted to Forbes Hospital with multiple broken ribs, pressure on his lungs and an injury to an artery.

The Eddys are represented by Carl R. Schiffman from Schiffman Firm, LLC.
