Woman sues 823 Donuts for pregnancy discrimination

Brianna Minicozzi claims she faced discrimination while employed at 823 Donuts' Stroudsburg facility after notifying her employer of her pregnancy in November 2022. Her lawyer, David L. Deratzian, asserts that despite providing medical documentation recommending limited work hours, her pay was reduced from $925 to $740 per week based on altered payroll records directed by Michael Roy. She continued working until her termination on February 13, 2023.

The plaintiff alleges significant damages including loss of past and future income exceeding $100,000 each, as well as severe emotional distress. She seeks compensatory damages for pain and suffering, economic loss, declaratory and injunctive relief to prevent further unlawful practices by the defendants.

In the United States District Court for the Middle District of Pennsylvania, Brianna Minicozzi has filed a lawsuit against 823 Donuts LLC, Cindy Sena, Michael Roy, and Marina Roy. The case ID is 3:24-cv-00774-JKM, and it was filed on May 8, 2024. The lawsuit alleges sex and pregnancy-based discrimination under the Pennsylvania Human Relations Act and Title VII of the Civil Rights Acts of 1964 and 1991 as modified by the Pregnancy Discrimination Act of 1978.

Minicozzi requests the court to award traditional tort remedies such as compensatory damages for physical and emotional distress, economic losses including back pay and front pay, punitive damages exceeding $100,000 due to the egregious nature of the defendants' actions, pre- and post-judgment interest, costs of suit including attorney fees, and any other just relief deemed appropriate by the court.
