Gabriel Broida has filed a lawsuit against Holovisn LLC, Nicklas Brucker, Eric Lloyd, and Shawn Landgraf. The lawsuit seeks damages and equitable relief for unpaid wages and overtime compensation under both federal and state laws.
Broida alleges that during his employment with Holovisn from 2021 to 2023, he was misclassified as an independent contractor instead of a non-exempt employee. This misclassification led to unpaid overtime wages in violation of the Fair Labor Standards Act (FLSA) and the Pennsylvania Minimum Wage Act (PMWA). His attorney, Adam Pollock of Pollock Cohen LLP, claims that Broida's final paycheck of $1,400 was due on November 15, 2023 but remains unpaid.
The lawsuit was filed in United States District Court for the Western District of Pennsylvania. The case, identified as No. 2:24-cv-00672-NBF, was filed on May 6, 2024.
In addition to the $1,400 in unpaid wages, Broida is seeking $500 in liquidated damages under Pennsylvania’s Wage Payment Collection Law. He also demands compensation for unpaid overtime wages along with liquidated damages as provided by both FLSA and PMWA. Furthermore, Broida requests reasonable attorneys’ fees and costs associated with the lawsuit.
