Thane Young has filed a civil action complaint against Keystone Cement Co., alleging violations of the Americans with Disabilities Act (ADA), the Family Medical Leave Act (FMLA), and the Pennsylvania Human Relations Act (PHRA). The complaint was filed on May 17, 2024, in the United States District Court for the Eastern District of Pennsylvania.
According to the complaint, Thane Young began his employment with Keystone Cement Co. as a Support Engineer on July 26, 2021. During his tenure, he maintained an excellent attendance and performance record. However, in July 2022, Young was involved in a motor vehicle accident that resulted in injuries to both of his shoulders. While his right shoulder healed over time, his left shoulder worsened and was diagnosed with a torn labrum.
In January 2023, Young approached Keystone Cement's Human Resources department to inquire about taking time off for potential shoulder surgery. He alleges that HR representative Gretchen Scippio provided no assistance or guidance. Subsequently, on January 10, he requested a day off for a doctor's appointment and returned to work the following day. Despite his excellent performance record and positive feedback from colleagues and management, Young was terminated by HR Director Eric Bayda on January 13, 2023.
Young contends that his termination was directly related to his disability and need for medical leave. He asserts that Keystone Cement Co. failed to engage in an interactive discussion regarding reasonable accommodations for his disability and did not provide necessary accommodations as required by law. Furthermore, he claims that the company retaliated against him for exercising his rights under the ADA and FMLA.
The plaintiff is seeking compensatory damages exceeding $150,000 for economic loss, future lost earning capacity, emotional distress, pain and suffering, among other damages. Additionally, he demands punitive damages and attorneys' fees.
