Lawsuit says Sadsbury Park lifeguard was on her phone while minor was drowning

MEDIA - A father is suing several entities after his child was left drowning for two minutes as a lifeguard didn't notice because she was on her phone.

A lawsuit was filed May 14 in the Delaware County Court of Common Pleas by John Wesley, acting as parent and natural guardian of a minor referred to as CW. The defendants in the case are Grube’s Pool Service, Trident Property Management LLC, Sadsbury Park Community Association, and John Doe (1-10).

The complaint alleges that on May 30, 2022, CW suffered injuries and damages due to a near-fatal drowning incident at a community pool managed by the defendants. 

The plaintiffs claim that the lifeguard on duty was negligent in her duties, being distracted by their cell phone at the time of the incident. It is also alleged that this behavior was known and routinely overlooked by the defendants.

CW was pulled from the water by her brother and went into cardiac arrest. Another pool-goer administered CPR, and CW was taken to the pediatric intensive care unit at Children's Hospital in Philadelphia.
