As a result of her fall, Mary Payne sustained significant injuries including a fracture of her right distal femoral shaft and right patella, necessitating eventual knee replacement surgery. The complaint states that these injuries have led to substantial medical expenses and loss of earnings for Mary Payne. Additionally, she has experienced great physical pain, mental anguish, embarrassment, and humiliation.
VanBuren Payne also seeks damages for loss of consortium with his wife due to her injuries. Both plaintiffs are demanding judgment against Murphy African Methodist Episcopal Church in excess of $50,000 each plus costs.
