Plaintiff alleges negligence against Kalahari Resorts over unsafe conditions leading to injury

Imran Ahmed has filed a negligence complaint against Kalahari Resorts & Conventions — Poconos, Kalahari Resorts PA, LLC, and Kalahari Resorts, LLC. The complaint was filed on May 22, 2024, in the United States District Court for the Middle District of Pennsylvania.

According to the court documents, Ahmed alleges that on February 7, 2023, he was a paying customer at the Kalahari Indoor Waterpark located at 250 Kalahari Boulevard in Pocono Manor, New Jersey. During his visit, Ahmed claims he slipped and fell on stairs covered with mold or algae due to improper maintenance by the defendants. The plaintiff asserts that the defendants had an obligation to ensure the safety and proper upkeep of their property but failed to do so. "At all times relevant," states Ahmed's complaint, "the steps at the Kalahari Indoor Waterpark were not properly treated and were covered with mold or algae."

Ahmed's fall resulted in serious injuries including damage to his muscles, bones, tendons, ligaments, right shoulder labral tear, biceps tenosynovitis in his right shoulder, olecranon bursitis in his right elbow among other conditions. He argues that these injuries have caused him significant pain and suffering as well as financial burdens due to medical expenses and loss of earnings. "As a direct and proximate result of the negligence and carelessness of Defendant," reads the complaint, "Plaintiff sustained serious and permanent injuries which caused a serious impairment of body function."

The plaintiff accuses Kalahari Resorts & Conventions — Poconos along with its associated entities of failing to maintain safe conditions on their premises. Specific allegations include neglecting to clean or treat hazardous areas such as stairs prone to mold or algae accumulation; failing to warn patrons about potential dangers; inadequate supervision; negligent hiring practices; and insufficient training for employees regarding safety protocols.

Ahmed is seeking compensatory damages for his injuries along with any other relief deemed reasonable by the court. He also demands a jury trial for each defendant involved in this case.
