Allegheny County concrete plant called a public nuisance in lawsuit

PITTSBURGH - A class action lawsuit claims a concrete plant in Coraopolis is sending dust, noise and vibrations into the surrounding community.

Plaintiff Colin Schreiber filed a lawsuit May 23 in Allegheny County Court of Common Pleas against Frank Bryan, Inc. and Riverside Concrete & Supply, Inc.

The suit alleges that the defendants' concrete manufacturing plant has caused significant environmental disturbances, including concrete dust, noxious odors, noise and vibrations that have negatively impacted Schreiber's property and his neighbors since 2021.

The complaint claims these invasions have worsened due to increased production at the plant to supply concrete for a new terminal at Pittsburgh International Airport.

Schreiber asserts that these issues constitute public and private nuisance, negligence, trespass, and violations of Pennsylvania’s Clean Streams Law. 

The lawsuit seeks compensatory damages for diminished property values and loss of enjoyment of properties. Additionally, it demands injunctive relief to prevent further emissions and disturbances from the plant.

The plaintiff is represented by Timothy Fitchett and other attorneys from Fair Shake Environmental Legal Services and East End Trial Group LLC.
