Plaintiff Alleges Danville Hotel Violated ADA Due To Inaccessible Facilities

In a compelling lawsuit filed on June 10, 2024, in the United States District Court for the Middle District of Pennsylvania, a plaintiff alleges significant violations of the Americans with Disabilities Act (ADA) by a prominent hotel. The complaint, brought forth by Derek Mortland against Danville Hotel, Inc., accuses the hotel of failing to provide necessary accommodations for individuals with physical disabilities.

According to the court documents, Mr. Mortland, who uses a wheelchair due to his physical disability, visited the Best Western hotel operated by Danville Hotel, Inc. from February 24 to February 25, 2023. During his stay at the property located at 125 Old Valley School Road in Danville, Pennsylvania, he encountered numerous architectural barriers that denied him full and equal access to the hotel's facilities. These barriers were present in critical areas such as the parking lot, front entrance area, guestroom 309, breakfast area, men's public restroom, vending machine area, front desk, exterior accessible routes, and other accessible guest rooms.

The lawsuit highlights that these barriers not only caused physical injury but also led to embarrassment and humiliation for Mr. Mortland. The plaintiff asserts that these violations are clear breaches of federal legal requirements under Title III of the ADA (42 U.S.C. §§ 12181 et seq.), which mandates that public accommodations must be accessible to individuals with disabilities.

Mr. Mortland's complaint details how he believes Danville Hotel Inc., as both landlord and operator of the Best Western hotel franchisee location in question, has neglected its duty to identify and remove these architectural barriers despite having actual notice of their existence. He emphasizes that this neglect demonstrates an intent not to comply with ADA standards both presently and in future operations.

The plaintiff seeks injunctive relief compelling Danville Hotel Inc. to make necessary modifications ensuring accessibility for individuals with disabilities. Additionally, Mr. Mortland requests attorneys' fees and litigation expenses should he be deemed the prevailing party in this case.
