A man is suing a Pennsylvania borough, county, and state agency over injuries sustained from a defective road. Darren Dale filed the complaint in the Court of Common Pleas of Delaware County on July 4, 2022, against the Borough of Folcroft, County of Delaware, and the Commonwealth of Pennsylvania Department of Transportation.
According to the complaint, Darren Dale was riding his electric scooter on Primos Avenue and Hook Road in Folcroft when he encountered a ditch or hole in the roadway. The lawsuit alleges that this dangerous condition caused him to fall and sustain serious injuries. Dale claims that the defendants were negligent in their duty to maintain and repair the roadways under their control. He asserts that they failed to correct known hazards, did not place adequate warning signs, and did not comply with relevant state or local ordinances related to road construction and repair.
