Pittsburgh Woman Sues Local Restaurant Chain Over Alleged Negligence Leading to Severe Injuries

A Pittsburgh woman has filed a lawsuit against a popular local restaurant chain, alleging severe injuries due to a defective seating apparatus. On October 13, 2023, Pamela Demitras filed the complaint in the Court of Common Pleas of Allegheny County against Primanti Bros. Restaurant Corporation.

According to the complaint, Demitras was visiting the Primanti Bros. location at 1539 Washington Road in Mount Lebanon when she experienced a harrowing incident. While seated on a stool at the bar, she claims that the stool tipped forward unexpectedly, causing her to fall and sustain significant injuries. The lawsuit alleges that the stool was balancing precariously on its front two legs before it slid out from under her, resulting in her hitting her head and back.

Demitras's legal team, led by attorney Laura R. Signorelli of Morgan & Morgan Philadelphia PLLC, argues that Primanti Bros. failed in their duty to maintain safe premises for their patrons. "Defendant had a duty to maintain the premises in a reasonably safe condition and to ensure that all seating apparatuses were free from hazardous defects," states the complaint. It further accuses Primanti Bros. of neglecting regular equipment maintenance and safety inspections which could have prevented such an incident.

The plaintiff lists several specific failures on part of Primanti Bros., including allowing defective seating apparatuses to remain on the premises, failing to warn patrons about potential hazards, and not ensuring that floor surfaces were skid-free and clean. The complaint asserts that these oversights directly contributed to Demitras's fall and subsequent injuries.

As a result of this incident, Demitras claims she has suffered from multiple injuries including a concussion, bruised tailbone, ongoing headaches, speech issues, memory problems, diminished earning capacity, and reduced quality of life among others. The lawsuit seeks compensatory damages exceeding $50,000 for medical expenses, lost wages, pain and suffering, and other related costs.
