A former employee has filed a lawsuit against a prominent casino and hotel operator, alleging violations of the Americans with Disabilities Act (ADA) and other state laws. The complaint was filed by Agnieszka Dybas in the United States District Court for the Eastern District of Pennsylvania on June 19, 2024, against Stadium Casino RE, LLC d/b/a Live! Casino & Hotel and The Cordish Companies, Inc.
According to the complaint, Dybas began her employment as a Full-Time Dual Rate Poker Dealer on July 17, 2023. She claims that during her tenure, she suffered from a knee injury while performing work-related duties on September 2, 2023. This injury was exacerbated on October 13, 2023, resulting in severe pain and limited mobility. Dybas informed her supervisors about her condition and subsequently filed a worker’s compensation claim. Despite her dedication and positive performance reviews prior to her injury, Dybas alleges that she faced discriminatory treatment following her medical leave and requests for reasonable accommodations.
The complaint details how Dybas requested light-duty assignments upon returning to work due to ongoing pain and mobility issues. Initially reassured by management that her job was secure, she later experienced increased scrutiny and pressure to return to full duty despite medical advice suggesting otherwise. Her probationary period was extended without clear justification, and she faced pretextual disciplinary actions related to her disability-related absences.
Dybas asserts that these actions created a hostile work environment and were in retaliation for her disability status and accommodation requests. She also believes that her termination on December 27, 2023, was pretextual and directly linked to her disabilities and complaints of discrimination. Furthermore, Dybas contends that she was wrongfully terminated in retaliation for seeking worker’s compensation benefits.
In seeking relief from the court, Dybas requests compensation for lost wages and benefits including back pay, front pay, salary increases, bonuses, insurance benefits, training opportunities, promotions reinstatement or seniority adjustments where applicable. Additionally, she seeks punitive damages for the defendants' alleged willful misconduct as well as damages for emotional distress. Lastly she is requesting coverage of legal costs associated with this action.
