PHILADELPHIA - Amazon wants a federal court to order arbitration in a dispute brought by one of its drivers it says was operating as a contractor and who later participated in a class action.
Amazon.com, Inc. and Amazon Logistics, Inc. filed a petition June 14 in the United States District Court for the Eastern District of Pennsylvania to compel arbitration against Jessica Fleurimond.
The case seeks to enforce arbitration agreements that Fleurimond allegedly accepted when she enrolled in Amazon's Flex program as an independent contractor.
Despite agreeing to resolve disputes through binding arbitration, Fleurimond joined a collective action seeking employee status under federal and state laws. Amazon is invoking the Federal Arbitration Act, the Washington Arbitration Act, and the Pennsylvania Arbitration Act to compel arbitration and prevent Fleurimond from pursuing her claims in court.
