Springfield Township Official Alleges Negligence Against Local Businesses Over Injury

A Pennsylvania man is seeking justice after a serious injury on a neighboring property. Edward Abel filed a complaint in the Court of Common Pleas of Delaware County, Pennsylvania, on May 3, 2023, against Paul Campanella’s Auto and Tire Center and several other defendants.

The lawsuit stems from an incident that occurred on December 24, 2022. Abel, who serves as the Director of Licensing and Inspection for Springfield Township, was responding to a call about a property adjacent to 724 S. Chester Road in Swarthmore, PA. While traversing the property owned by the defendants to reach Swiss Farms next door, Abel tripped over bolts protruding from the ground and sustained severe injuries. The defendants named in the case include Paul Campanella’s Auto and Tire Center, Bancroft Construction, Swarthmore Automotive LLC, and Campanella Swarthmore LLC.

According to the complaint filed by Abel's attorney Daniel S. Doyle of Brooks, Bradley & Doyle law firm, all defendants had control over the property where the accident occurred. The complaint accuses them of negligence for failing to maintain safe conditions on their premises. "All of the Defendants knew and/or should have known that the dangerous condition existed on the property at the time of Plaintiff's fall," states the complaint.

Abel suffered significant injuries including damage to his kneecap, a ruptured quadricep tendon, severe acute neuropathy involving his left ulnar nerve at his wrist and forearm, and cervical spine herniations. These injuries have led to substantial medical expenses and ongoing physical and mental suffering for Abel. He claims that these conditions could be permanent.

The lawsuit lists multiple allegations against the defendants: failing to prevent hazardous conditions from arising on their premises; permitting dangerous conditions to exist; not properly warning about these dangers; neglecting necessary maintenance; allowing their property to become unsafe; failing to inspect or repair defects; violating local laws and regulations; and not maintaining proper standards of care.

Additionally, Abel's complaint includes a count of negligence per se against Campanella Swarthmore LLC based on their guilty plea to violating local ordinance LO § 79 §§ 6A which aims to protect residents from hazardous conditions like those that caused Abel's injuries.

Abel seeks judgment against all defendants in excess of $50,000 for each count cited in his complaint. He demands compensation for medical expenses incurred and anticipated future costs due to his injuries. He also seeks damages for physical pain, mental suffering, loss of life's pleasures, humiliation, and embarrassment resulting from this incident.
