Restaurant Patron Sues Ocean Super Buffet Over Severe Food-Borne Illness

A recent court filing reveals a dramatic case of alleged negligence that resulted in severe food-borne illness for a restaurant patron. On June 25, 2024, Valia Johnson filed a complaint in the Court of Common Pleas of Delaware County, PA against Ocean Super Buffet, Inc., accusing the restaurant of serving contaminated food.

According to the complaint, on November 6, 2023, Valia Johnson visited Ocean Super Buffet located at 1936 MacDade Blvd., Woodlyn, PA. As a business invitee, she was owed the highest duty of care by the establishment. However, Johnson alleges that the restaurant failed to meet this obligation when it served her contaminated food that led to serious and permanent personal injuries. The lawsuit claims that the injuries were caused solely by the negligence of Ocean Super Buffet and its unknown associated entities named as John Doe Corporations 1-5.

The plaintiff details her ordeal in the complaint: "As a result of Defendant’s negligence and failure to prepare and provide clean and safe foods to its customers, Plaintiff was caused to sustain injury in the form of food-borne illness." She further accuses Ocean Super Buffet of failing to properly cook, prepare, and serve food in a safe manner. This negligence allegedly resulted in painful and severe injuries for Johnson, which include ongoing medical expenses and significant physical and mental suffering.

Johnson is seeking judgment against all defendants jointly or severally for an amount exceeding $50,000. This sum is intended to cover medical expenses, compensation for pain and suffering, loss of life's pleasures and enjoyment, work loss, loss of earning capacity, humiliation and embarrassment among other damages. The plaintiff's attorney argues that these claims are valid given the severity and permanence of Johnson's injuries.

The case is being handled by Kenneth R. Schuster & Associates with Justin M. Bernstein serving as counsel for the plaintiff.
