Philadelphia Woman Sues Giant Food Supermarket Over Negligence Leading To Injuries

A Philadelphia woman has filed a lawsuit against a prominent supermarket chain, alleging negligence that led to her sustaining significant injuries. Gloria Smith initiated the complaint in the Delaware County Court of Common Pleas on June 20, 2024, naming Giant Food Supermarket as the defendant.

According to the court documents, Smith was shopping at the Giant Food Supermarket located at 300 E. Baltimore Avenue in Lansdowne, PA, on July 10, 2023. During her visit, she slipped and fell due to spilled juice on the floor of one of the aisles. The plaintiff asserts that this incident resulted from the negligence and carelessness of Giant Food Supermarket and its employees. Smith claims that the store failed to maintain a safe environment for its customers by not placing adequate safety precaution signs or warning patrons about the spill.

The lawsuit details several accusations against Giant Food Supermarket. These include failing to warn individuals like Smith about hazardous conditions such as liquid spills, allowing customers to walk through dangerous areas without sufficient precautions, and neglecting to remedy unsafe conditions despite having ample time to do so. "The negligence and/or carelessness of Defendant," reads one part of the complaint, "consisted of failing to maintain a safety precaution sign that could prevent unreasonably dangerous conditions."

Smith's injuries from the fall were severe enough to warrant legal action. She sustained injuries to her head, back, and right knee, leading to significant pain and suffering. The complaint also mentions emotional distress alongside physical injuries. "Plaintiff has suffered emotional injuries along with physical injuries," it states, further noting diminished quality of life and loss of life's pleasures as additional consequences.

In terms of relief sought from the court, Smith is demanding judgment in her favor amounting to $50,000 plus all reasonable costs associated with her case. She seeks compensation for medical expenses—both past and future—loss of earnings or earning capacity due to her injuries, and other related costs exceeding any applicable health insurance coverage.
