A routine manicure turned into a painful ordeal for a Delaware woman, leading to a lawsuit against a local nail salon and its operators. Lorie Ann Marvel filed a complaint on July 2, 2024, in the Court of Common Pleas of Delaware County, accusing Red Lion Nails & Spa LLC and its associated individuals of negligence resulting in personal injury.
According to the court documents, Marvel alleges that during her visit to Red Lion Nails & Spa LLC on June 11, 2023, she received a manicure using unsafe and unsanitary tools. This negligence allegedly caused her to suffer from an infection and cellulitis in her thumb, ring, and middle fingers. The complaint details that the tools used were defective, dirty, and unsterilized, leading to severe redness, pain, and discomfort for Marvel.
The lawsuit names Andy Chan, Le Phuong Thao Thi, and Thi Xuan Thao as co-defendants alongside Red Lion Nails & Spa LLC. Each defendant is accused of failing to properly maintain the premises and ensure the safety of their clients. "The incident complained of was caused solely and exclusively by reason of the negligence and/or carelessness of the Defendants," states the complaint.
Marvel's attorney Yekaterina Koelsch argues that the defendants failed in multiple aspects: operating manicure tools negligently without regard for client safety; not sanitizing or sterilizing tools properly; allowing incompetent personnel to perform manicures; and neglecting to inspect or maintain equipment in safe conditions. The lawsuit further claims that these failures led to serious injuries for Marvel which have caused her ongoing physical pain, emotional distress, financial loss due to medical expenses, and potential future loss of earnings.
In addition to detailing the alleged negligence surrounding the manicure procedure itself, Marvel's complaint also accuses the defendants of violating Pennsylvania state laws regarding sanitary practices in cosmetic services. The plaintiff seeks judgment against each defendant for an amount not exceeding $50,000 plus reasonable attorney fees and other court-deemed necessary reliefs.
The case is set before Judge Barry Dozor with attorneys from Kwartler Manus LLC representing Marvel. The defendants are yet to respond formally within the stipulated time frame provided by Pennsylvania law.
