Customer Sues Home Improvement Giant Over Severe Injuries Caused by Negligence

A shocking incident at a popular retail store has led to a lawsuit that could have significant implications for customer safety standards. On July 30, 2022, Harold Strickland filed a complaint in the Court of Common Pleas of Lackawanna County against Home Depot USA, Inc., alleging negligence that resulted in severe injuries.

According to the court documents, Strickland was shopping at Home Depot Store #4118 located at 800 Commerce Boulevard in Dickson City, Pennsylvania when the incident occurred. While reaching for bags of gravel on a shelf, his right arm became caught on an exposed nail protruding from a pallet. This caused a puncture wound and damaged his right ulnar nerve. In an attempt to free himself, Strickland struck his right elbow on the metal shelf, exacerbating his injuries.

The plaintiff's attorney, P. Timothy Kelly of Needle Law, P.C., detailed several allegations against Home Depot in the complaint. These include failure to warn customers about dangerous conditions such as exposed nails, neglecting to discover and remove hazardous conditions before they caused harm, and allowing such dangers to be concealed from customers' view. "The defendant's negligent and careless conduct directly led to Mr. Strickland's injuries," stated Kelly.

Strickland claims that as a result of this accident, he has suffered significant physical and mental pain and will continue to do so indefinitely. The injuries have necessitated medical treatment and hospitalization, leading to substantial financial losses. Additionally, Strickland asserts that he has been temporarily disabled and unable to perform his usual daily activities since the incident.

The lawsuit seeks damages exceeding $50,000 plus interest and costs. The plaintiff is asking for compensation for medical expenses already incurred and those anticipated in the future due to ongoing treatment needs. Furthermore, Strickland is seeking damages for pain and suffering as well as permanent scarring and cosmetic disfigurement resulting from the injury.
